Injured as a Passenger in a Ridesharing Vehicle?

If you have never used a ridesharing service, you have likely at least heard of companies such as Uber and Lyft. With millions of Americans using these ridesharing services every day, they have become a popular mode of transportation. However, these vehicles are just as likely to be in an accident as any other vehicle, even if the drivers are subjected to background checks. If you were involved in an accident as a passenger of an Uber, you should follow the same protocol as a typical car accident: Call 911, get a police report, obtain all drivers’ insurance information, obtain all witness contact information, and seek medical attention. If you were injured in a car accident as a passenger in an Uber or Lyft there are many different parties you may be able to seek compensation from, and determining liability can be challenging and complex.

Determination of Liability  

A determination of fault must be made in your car accident as a passenger in an Uber or Lyft just like any other car accident. Your Uber or Lyft driver could be responsible, the other driver could be responsible, or in some cases, both drivers will have a portion of liability due to their negligence. Some ridesharing companies have special car insurance for their drivers. However, even in these cases, company insurance may be considered secondary to the driver’s own personal insurance. Some drivers will carry a type of insurance that covers “commercial driving” and others will not.

Therefore, as a passenger, you will rely upon the police report to determine who is considered liable and responsible for your injuries. After the determination of liability is made, you will be able to proceed with filing a claim with that driver (or both drivers) insurance companies.

Filing a Claim With an Insurance Company

Unless your accident was caused as a result of a manufacturing defect, there are two parties’ insurance companies with whom you may be able to file a claim. However, the process to receive compensation for your injuries can be challenging even when liability has been determined.

  • Your Uber or Lyft Driver is Liable. If your Uber or Lyft driver is determined to be at-fault and liable for the accident, you may be able to file a claim with the driver’s personal insurance policy. If your driver’s insurance policy does not cover Uber or Lyft drivers, you may have the opportunity to file a claim directly with Uber’s company insurance policy for drivers.
  • Other Driver Liable. If the other driver is determined to be liable for the accident, the process works just the same as a typical car accident. As an Uber or Lyft passenger of the other vehicle, you will file against the other driver’s insurance policy for any outstanding medical bills, lost wages or pain and suffering.
