How Should I Pay My Medical Bills with a Pending Personal Injury Case?

The period following a personal injury and the start to resolution of a personal injury case can be fraught with anxiety. One of the biggest contributors to this anxiety is the concern about how to pay the medical bills resulting from the injury. Fortunately, there are a number of options as to how those bills are paid and processed while a personal injury case is pending.

If you are injured in a motor vehicle accident in Florida and have auto insurance, you have $10,000 of Personal Injury Protection (“PIP”) benefits available to pay towards your medical expenses.  When you visit a health care provider for treatment of injuries related to your accident be sure to provide your PIP claim number (your automobile insurance carrier will assign a PIP claim number to you when you first report the accident) and your health insurance information (if you have health insurance). Your PIP carrier will pay the accident-related medical bills while you are treating, and what is not paid by PIP may be processed and paid by your health insurance.

Many people have Medical Payment coverage (“med-pay”) on their automobile or motorcycle insurance policy that can also help in paying medical expenses resulting from a vehicle accident. Many times, these policies can also cover you when you are involved in an accident as a pedestrian or bicyclist where another vehicle is involved. Since these policies are generally designed to pay upon receiving a bill from a medical service provider, you may not have to wait until the close of your case to get the expenses paid.

If your PIP coverage is fully paid out and you still require more treatment, your treating providers may submit their ongoing bills to available health insurance.  In the event your injuries are due to an accident other than a motor vehicle accident, such as a fall down accident, and you do not have health insurance or your health insurance provider does not pay some of the accrued expenses, many medical providers are willing to wait to have their outstanding bills paid from the settlement of your personal injury case or any monetary recovery obtained after a jury trial.

Skilled and experienced personal injury attorneys will have complete and up to date medical records and medical billing information to submit to the negligent party’s insurance carrier to support your personal injury claim at such time that a demand for settlement is made.

By choosing a personal injury attorney with experience and a good track record in these cases, you will be enlisting an advocate who will work to ensure that you do not suffer further financial hardship as a result of an accident. The goal of an experienced personal injury lawyer and personal injury law firms is to not only win the best possible settlement in your case, but to also help you through the process at every turn so that recovery is not hampered by anxiety brought on by medical expenses.
